Important: These Terms govern your access to and use of tracemood.com (the “Site”) and any related services. The Site is a personal, non-commercial project operated by an individual (the “Operator”). By using the Site, you agree to these Terms.

Informational only — no payments on this Site

• The Site presents editorial and artistic content for information only.
• The Site does not process payments, sell goods or services, or solicit employment or work.
• Any future app-related purchases, if offered, would occur off-site through a platform store (e.g., Apple App Store) under that platform’s terms. Visiting this Site does not create any transaction, client/customer relationship, or offer to sell in any place.

Commerce change notice

If paid features or digital items are later added, updated terms will be published before any purchase is offered. Until then, the Site remains informational only and processes no payments.

Assignment and entity step-up

The Operator may assign rights and obligations under these Terms to an entity the Operator controls or that is under common control (for example, if a company is formed). Any assignment will not reduce protections for the content and will not change your rights to any purchased items.

Platform store rules

If an app offers purchases, the platform store’s terms govern billing, taxes, delivery, and refunds. Those platform rules control if they conflict with these Terms.

App and digital content license (if later offered)

For any app or digital items purchased through a platform store, you receive a limited, non-exclusive, revocable, non-transferable license for personal, non-commercial use only. You may not:

• resell, sublicense, publicly display, distribute, adapt, or create datasets from the content;
• use any content to train, fine-tune, evaluate, embed, cache, or improve any machine learning or AI system;
• remove watermarks or copyright notices.

The Operator may revoke any license for breach and may disable access to items that violate these Terms. All rights are reserved.

No resale or redistribution

You may not resell, rent, lease, lend, broadcast, or redistribute any content or digital item from Trace Mood. You may not mint, issue, or otherwise create tokens or similar records that reference or incorporate the content.

Brand and trademark notice

Trace Mood and related names, logos, and designs are claimed as trademarks and trade dress of the Operator. No license is granted. You may reference the name in plain text with truthful attribution only. Use that suggests endorsement is not allowed.

Enforcement and takedown

The Operator may use technical and legal measures to protect the Site, any app, and the content, including watermarking, rate limits, hotlink protection, and removal requests to hosting and platform providers. Reports can be sent to contact@tracemood.com. The Operator may seek injunctive relief and monetary damages for infringement or misuse.

Jurisdiction and presence

The Site is a personal publication. It does not state or create a place of business, a permanent establishment, or a tax presence in any jurisdiction. Nothing on the Site is an offer or invitation to do business where such activity would be unlawful.

Copyright and intellectual property

All content (including images, text, designs, layouts, code, and marks) is owned by the Operator or licensors and protected by law. All rights reserved. Accessing the Site grants no rights beyond viewing in a standard web browser for personal, non-commercial purposes.

• No AI or dataset use: You may not use any content (including thumbnails, metadata, filenames, captions, or alt text) to train, fine-tune, evaluate, embed, cache, or improve any machine learning or AI system, or to build datasets, benchmarks, or model weights.
• No scraping or bulk use: You may not copy, scrape, crawl, mine, archive, frame, mirror, or bulk download the Site or its content, including by automated means, headless browsers, or AI agents.
• No circumvention: You may not circumvent technical measures (e.g., rate limits, WAF rules, hotlink protection, robots rules), or remove/alter copyright notices, watermarks, or metadata.

Limited quotations of brief text for commentary or review are permitted with clear attribution and a visible link to the source page. Any other use requires prior written permission. For licensing (editorial or commercial), email contact@tracemood.com with subject “Licensing”. No use is permitted unless and until you receive written permission.

Prohibited uses

You agree not to:

• copy, scrape, mine, archive, or bulk download the Site or content;
• use content for AI or dataset creation (including embeddings, caches, or benchmarks);
• remove or alter copyright notices, watermarks, or metadata;
• circumvent or interfere with security features, rate limits, bot protections, or access controls; access non-public areas;
• frame, mirror, or present the Site in a way that suggests endorsement without written permission;
• use the Site for unlawful, infringing, or harmful purposes or in violation of export or sanctions laws.

Linking

You may link to public pages in a fair and legal manner that does not mislead, suggest endorsement, or bypass access controls. The Operator may withdraw linking permission at any time.

No professional advice & immigration note

Content on the Site and any email replies are personal/editorial opinions and not legal, immigration, financial, medical, or other professional advice. No attorney-client or other professional relationship is created.

Important: The Operator does not assist with hiding, misrepresenting, or avoiding compliance with immigration or border control laws. If an app is later commercialized, ensure all required registrations, taxes, and disclosures are handled through the correct platforms and advisors. This Site is not a storefront and processes no payments.

User submissions (feedback)

If you send feedback or suggestions, you grant the Operator a worldwide, royalty-free, perpetual, irrevocable license to use and incorporate them without obligation to you.

Unsolicited works

The Operator does not accept unsolicited creative works. Unsolicited submissions may be deleted without review and create no confidential or fiduciary relationship.

Service changes and availability

The Operator may modify, suspend, or discontinue any part of the Site without notice and is not liable for any unavailability or modification.

Copyright complaints and takedown requests

If you believe content infringes your rights, email contact@tracemood.com with subject “Copyright Notice” and include: (1) a description of the work; (2) the exact location (URL) on the Site; and (3) your contact information. If you believe content was removed in error, email with subject “Counter Notice” and include your explanation and contact information. The Operator may remove or restrict access while reviewing.

Remedies and enforcement

The Operator may pursue all available remedies, including injunctive relief, account-level or network-level blocking, and recovery of damages and costs.

Export controls and sanctions

You are responsible for compliance with applicable export control and sanctions laws.

Dispute resolution

These Terms and any dispute or claim will be interpreted under the laws of the place where the Operator resides at the time the claim is filed, unless a different law is required by a law that protects you where you live. The exclusive forum will be a competent court in that place, unless another forum is required by a law that protects you where you live.

Changes

The Operator may update these Terms. Your continued use after changes become effective constitutes acceptance.

Termination

The Operator may suspend or terminate access to the Site at any time, with or without notice, for any reason. Upon termination, any rights granted to you under these Terms immediately cease.

Miscellaneous

If any provision is held unenforceable, the rest remains in effect. These Terms are the entire agreement between you and the Operator regarding the Site. Headings are for convenience only. No agency, partnership, employment, or joint venture is created by your use of the Site.
